Article 1 – Seller Identification
These General Terms and Conditions of Sale (hereinafter “GTC”) are concluded between:

(hereinafter “the Seller” or “the Company”)
AND
Any adult individual or legal entity making a purchase on the website www.josephandjacob.paris or from the Company (hereinafter “the Client”).
Article 2 – Purpose and Scope
The purpose of these GTC is to define the rights and obligations of the parties in connection with the online sale of JOSEPH & JACOB brand sunglasses and accessories, including products with personalized solar lens colors (hereinafter “the Products”).
These GTC apply exclusively to sales made to consumers residing in metropolitan France and in the overseas departments and territories (DOM-TOM). They prevail over any other document of the Client, unless prior written agreement of the Seller.
The Client declares having read and accepted these GTC before placing any order. This acceptance is materialized by a checkbox during the online order.
Article 3 – Products
3.1 Description
The Products offered for sale are JOSEPH & JACOB brand sunglasses and accessories. Each product is subject to a description specifying its essential characteristics (material, dimensions, UV protection, etc.).
The photographs and visuals presented on the site are as faithful as possible but cannot ensure a perfect correspondence with the actual product, especially concerning color shades depending on display settings.
3.2 Prescription Lenses
The Seller offers frames equipped with prescription lenses, mounted by a qualified optician within the Company. This service is subject to the following specific conditions:
• The Client must provide a valid prescription issued by an ophthalmologist or an authorized optician. In accordance with current French regulations (law of October 17, 2016 and decree of June 27, 2024), the validity periods are as follows: 1 year for those under 16; 5 years for people aged 16 to 42; 3 years for people aged 43 and over.
• The prescription can be sent electronically (scan or legible photo) when ordering, or by postal mail to the registered office address.
• The order will only be processed after receipt and verification of the prescription by the Company's qualified optician.
• Since prescription lenses are cut and mounted to measure according to the Client's prescription, these products are excluded from the right of withdrawal, in accordance with article L.221-28 of the Consumer Code, except for proven defect or non-conformity with the provided prescription.
• The processing and shipping time for an order with prescription lenses is 10 to 15 working days from the validation of the prescription.
The Seller declines all responsibility in case of an erroneous, unreadable, or incompletely transmitted prescription by the Client. In case of doubt about the validity or legibility of a prescription, the Seller will contact the Client before proceeding with the mounting.
3.3 Solar Lens Customization
The Seller offers a solar lens customization option allowing the Client to choose from a selection of available colors. This customization is offered for aesthetic purposes only and does not alter the technical characteristics of UV protection of the lenses.
Personalized products are manufactured upon the Client's specific request. Consequently:
• They cannot be returned or exchanged, except for proven defect or non-conformity.
• The processing and shipping time for a personalized order is 7 to 10 additional working days compared to standard orders.
• The Client is invited to carefully check their color selection before order validation, as no modification is possible after confirmation.
Article 4 – Price
The prices of the Products are indicated in euros (€) including all taxes (TTC), including applicable French VAT. Delivery is free for all orders, with no minimum purchase amount.
The Seller reserves the right to modify its prices at any time. The Products will be invoiced on the basis of the rates in force at the time of order validation.
In case of a clear pricing error (abnormal or clearly erroneous price), the Seller reserves the right to cancel the order, after having informed the Client, who will be fully reimbursed.
Article 5 – Order
The Client places their order online by following the successive steps on the site. The order is definitively registered only after:
• Filling out the order form (contact details, delivery address);
• Selecting the Products and, if applicable, customization options;
• Accepting these GTC;
• Validating the payment.
A summary confirmation email is sent to the Client within minutes of validating their order. This email does not constitute an invoice. The invoice is available in the client area or sent by email upon shipment.
The Seller reserves the right to refuse any order for legitimate reasons, particularly in the event of an unpaid previous dispute, suspicion of fraud, or insufficient stock availability.
Article 6 – Payment
Payment is due in full on the day the order is placed. The accepted payment methods are as follows:
• Credit card (Visa, Mastercard);
• PayPal;
• Payment in several interest-free installments via Alma (3x, 4x);
• Any other method offered on the site at the time of order.
Online payments are secured by SSL encryption. The Seller does not store any of the Client's banking data.
Article 7 – Delivery
7.1 Delivery Area
Deliveries are made in metropolitan France and in the overseas departments and regions (DOM-TOM). For any delivery to other countries, the Client is invited to contact customer service.
7.2 Deadlines and Modalities
Indicative delivery times for standard products are 5 to 7 working days from shipping confirmation. For products with lens customization, additional delays apply (see Article 3.2).
These deadlines are given for informational purposes. No delay can give rise to damages and interest, unless the delay is excessive and due to a fault of the Seller.
7.3 Receipt
Upon receipt, the Client must check the condition of the order and report any anomaly (damaged package, missing or defective product) to the carrier and the Seller within 72 hours.
Article 8 – Right of Withdrawal
In accordance with articles L.221-18 and following of the Consumer Code, the consumer Client has a period of fourteen (14) calendar days from receipt
of the Product to exercise their right of withdrawal, without having to give reasons or pay penalties.
To exercise this right, the Client must notify their decision by email to: contact@josephandjacob.paris, or by mail to the registered office address, clearly indicating their order and their decision to withdraw.
The Client returns the Product in its original and complete condition (packaging, accessories, instructions) at their own expense. The refund will be made within 14 days following receipt of the return.
Exception: in accordance with article L.221-28 of the Consumer Code, the right of withdrawal does not apply to personalized Products (lenses with color chosen by the Client), manufactured according to their specifications.
Article 9 – Warranties
9.1 Legal Guarantee of Conformity
The Seller is bound by the legal guarantee of conformity (articles L.217-4 to L.217-14 of the Consumer Code). The Client has a period of two (2) years from the delivery of the Product to act. The Client can choose between repair or replacement of the Product, subject to legal conditions.
9.2 Warranty against Hidden Defects
The Seller is liable for hidden defects (article 1641 of the Civil Code). The Client can choose between cancellation of the sale or a reduction in the selling price.
9.3 Exclusions
Warranties do not cover damages resulting from abnormal use, accident, negligence, or unauthorized modification of the Product.
Article 10 – Liability
The Seller cannot be held responsible for damages resulting from improper use of the Product, a case of force majeure, an unforeseeable and insurmountable act of a third party, or use contrary to the recommendations provided.
The Seller's liability is in any case limited to the amount of the order concerned.
Article 11 – Personal Data Protection
In the context of these presents, J2L EYEWEAR collects and processes the Client's personal data in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and the Data Protection Act.
The collected data (name, first name, address, e-mail, telephone) are used for the purpose of processing and tracking orders, managing customer relations, and, with the Client's consent, sending commercial communications.
The Client has a right of access, rectification, erasure, portability and opposition to their data, exercisable by e-mail to: contact@josephandjacob.paris.

Article 13 – Customer Service and Mediation

In case of an amicably unresolved dispute, the Client may free of charge resort to the consumer mediator designated by J2L EYEWEAR: the CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice), whose registered office is located at 14 rue Saint-Jean, 75017 Paris — www.cm2c.net, in accordance with articles L.611-1 and following of the Consumer Code. The Client can also use the European online dispute resolution platform (ODR) accessible at: https://ec.europa.eu/consumers/odr.
Article 14 – Applicable Law and Competent Jurisdiction
These GTC are subject to French law. In case of dispute, and after an attempt at amicable resolution, the competent French courts will be seized.
For consumers, the competent court is that of the Client's place of residence or that of the Product's delivery location, in accordance with article R.631-3 of the Consumer Code.
Article 15 – Amendments to the GTC
The Seller reserves the right to modify these GTC at any time. The new GTC will be applicable as soon as they are put online. Orders placed previously remain subject to the GTC in force at the time they were placed.
